Terms and Conditions for Real Estate:

Terms for Real Estate:  The purchaser shall pay 10% of the purchase price as a down payment at the auction site at the conclusion of bidding.  The balance is due with delivery of the deed on or before August 21st, 2026.

Mineral Rights:  All mineral rights owned by the seller, if any, are included in this sale.   

Deed:  Seller shall provide a General Warranty Deed.

Evidence of Title:  The Buyer will be responsible for any fees associated with the owner’s title insurance policy if one is desired.  Seller agrees to provide merchantable title to the property subject to matters of record, general conditions of title and similar related matters. All tracts are sold “AS IS”.

Real Estate Taxes:  The 2025 taxes due and payable in 2026 and the 2026 taxes due and payable in 2027 shall be paid as a credit to the buyer(s) at closing..

Closing: Closing shall occur on or before August 21st, 2026 at a location designated by the Seller. 

Farming Rights:  The farm is currently under a farming lease for 2026. The seller shall retain the farm rental income for the 2026 crop year. Possession shall be granted to the buyer when the crops are removed or December 31st, 2026, whichever comes first.

Conservation Easements and Programs:  Buyer shall assume the CRP contract and shall receive the annual CRP payments that are issued each October by the US Government.  Should the buyer choose to terminate the existing CRP contract, the buyer, at the buyer's expense, shall be responsible for all payments, fees and penalties incurred. 

Acreage:  All tract acreages and proposed boundaries are approximate and have been based on legal descriptions, aerial maps and other documents.
