located at 133 County Road 100N in Boonville, IN.

SALE #1: MILLERSBURG RD. – 237 acres selling in 13 tracts located 1.8 Miles north of Chandler, IN.
Directions: From Chandler, IN drive north on N State Street for 1.8 miles to Millersburg Rd and turn right. Drive .9 miles to the property on your Right. Watch for our signs!!!
Tract 1: 5.7+/- acres mostly wooded acres located on the SW corner of Millersburg Rd and Lakeshore Dr. This tract also has water available.
Tract 2: 7.7+/- acres partially wooded acres with 50’ of frontage along Millersburg Rd. Water is available along Lakeshore Drive

SALE #3: Stanley Tracts - 334+/- acres located to the east of Weyerbacher Rd., south of Stanley Rd and north of Holder Hill Rd about 5 miles east of Elberfeld, IN. These tracts are primarily recreational tracts (Hunting, fishing, ATV’s) or pasture for livestock with some woods and quite a few lakes.
Tract 1: 95.5+/- acre tract has frontage along Weyerbacher Rd and Stanley Rd. It has 2 smaller ponds and a about half of a larger lake. There is an existing haul road easement running along the northern portion of this tract.
Tract 2: (Tracts 2a & 2b) consists of 95.5+/- acres with frontage along Stanley Rd to the north. It also has a 50’ easement across the bottom of tract 1 which will exist until the Haul Road Easement to the north is abandoned. It also has 1 pond and about ½ of a larger lake on in.
Tract 3: (Tracts 3a & 3b) Consists of 78.9+/- acres and has frontage along Weyerbacher Rd. It is primarily pasture with some trees and part of a lake on the southwest corner.
Tract 4: 64.2+/- acres located on the corner of Weyerbacher Rd and Holder Hill Rd. It has a large lake on it. It is primarily pasture with some trees.

Terms and Conditions:
Terms for Real Estate: The purchaser shall pay 10% of the purchase price as a down payment at the auction site at the conclusion of bidding. The balance is due with delivery of the deed on or before March 31st, 2022.
Mineral Rights: Please see below for the terms for the mineral rights for each of the properties.
Sale #1 Properties (Tracts 1-13): As to the mineral rights of Seller pertaining to the “Millersburg Road Property” consisting of Parcel Number 87-09-19-300-014.000-002, 87-09-19-300-016.000-002, 87-09-19-400-012.000-002, 87-09-19-400-013.000-002 and 87-09-30-100-004.000-002, a parcel of land extending from the west boundary of the Millersburg Road Farm a distance of 1000’ to the east and running the entire length of the Millersburg Road Farm parallel to the west boundary of the Millersburg Road Farm (the “buffer parcel”) shall be sold with the minerals included. The exact location and boundaries of the buffer parcel shall be determined by a survey at Seller’s expense, with the boundaries to track the boundaries set forth on buffer zone map on Exhibit A to the Consent Decree dated February 26, 2019, in Warrick Superior Court, Cause No. 87D02-1801-PL-000116. The remainder of the Millersburg Road Farm shall be sold without the minerals included, except that Seller shall assign to the purchaser(s) of any portion of thereof a royalty in the amount of ten cents ($.10) per ton for any coal mined and sold from said remaining portion of the Millersburg Road Farm, or such portion thereof as the purchaser acquires through the auction. (Please refer to the Map that outlines the approximate location of the 1,000’ setback line). See the consent decree below as an attachment for details regarding mining and the $1,000' setback line.
Sale #2 (Farmland Tracts located along New Harmony Rd) (Tracts 1-3): The mineral rights of Seller pertaining to the “Rudolph Farm”, consisting of Parcel Numbers 87-09-03-300-014.000-002, 87-09-10-100-031.000-002 and 87-09-10-300-001.000-002 shall be included with the sale of the land.
Sale #3 (Tracts 1-4) Located along Weyerbacher & Stanley Rd: The mineral rights of Seller pertaining to the “Stanley Farm”, consisting of Parcel Numbers 87-05-19-100-020.000-009, 87-05-19-100-008.000-009 and 87-05-19-300-026.000-009 shall not be included with the sale of the land, except that Seller shall assign to the purchaser(s) of any portion of the Stanley Farm a royalty in the amount of one-half cent ($.005) per ton for any coal mined and sold from the Stanley Farm, or such portion thereof as the purchaser acquires through the auction.
Deed: Seller shall provide a General Warranty Deed.
Evidence of Title: The Buyer will be responsible for any fees associated with the owner’s title insurance policy if one is desired. Seller agrees to provide merchantable title to the property subject to matters of record, general conditions of title and similar related matters. All tracts are sold “AS IS”.
Real Estate Taxes: The property taxes shall be prorated to the date of closing.
Closing: Closing shall occur on or before March 31st, 2022.
Possession: Possession shall be granted with deed at closing.
Acreage: All tract acreages and proposed boundaries have been based off of survey, legal descriptions, aerial maps and other documents. Each parcel will be surveyed by the Seller prior to closing.
